Terms and Conditions for participation in ‘Will you be my Valentine’ (Promotion)

1. Information on how to enter and the prize form part of these Terms and Conditions.

2. Participation in the Promotion is deemed acceptance of these Terms and Conditions.

3. Entry is only open to Australian residents (Entrants).

4. Employees, directors and officers of the Promoter, agencies associated with this Promotion and all Retailers at the Shopping Centre and their immediate families are not eligible to enter the Promotion. Immediate families includes: spouses, de-facto spouse, child or step-child, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister and first cousins.

5. The Promotion commences on the Promotion Commencement Date and ends at the Promotion End Date (Promotion Period).

6. To enter the Promotion each Entrant must submit their entry during the Promotion Period which commences at 4pm on Monday 1st of February, and concludes at 5pm on Friday 12th February 2021. A Winner will be notified on Saturday 13/02/2021 via details provided on entry.

7. Suggest your dream Valentine’s Day outing that you might share with the Kenmore Village Valentine’s Day Teddy via the ‘Will you be my Valentine?’ entry page hosted at https://kenmorevillage.com.au/will-you-be-my-valentine/ on the Kenmore Village website. Each eligible entry will quality for a chance to win a $300 EFTPOS Kenmore Village Gift Card along with our large (soft-toy) plushie Teddy. Five (5) entries will be chosen for a draw on Friday 12/02/2021.

8. Only one entry per person will be accepted as a valid entry to this Promotion.

9. The Winner will be chosen at the discretion of the Kenmore Village Centre Management Office, Five (5) creative and romantic suggestions will be selected and placed into a prize draw using Woobox contest software to pick a winner. 

10. The draw for the prize will take place at 9 Brookfield Rd, Kenmore Qld 4069.

11. The Winner will be notified via details provided at the ‘Will you be my Valentine?’ website entry page upon entry submission.

12. The Winner must claim the prize from the Centre Management Office at the Shopping Centre by appointment only.

13. The Winner agrees to have their photo taken and used for publication on the Shopping Centre’s website, Facebook page, Instagram, e-newsletter and/or press.

14. The Promoter’s decision is final, and no correspondence will be entered into.

15. If for any reason the Winner does not collect the prize within 14 days of the Prize Draw Date, they will forfeit their right to the prize.

16. If the prize or part of the prize is unavailable the Promoter in its discretion reserves the right to substitute the prize or that part of the prize with a prize to the equal value and/or specification.

17. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right (subject to all relevant State and Federal laws), to cancel, terminate, modify or suspend the Promotion.

18. Once a prize has left the Promoter’s/supplier’s premises, the Promoter and its agencies and companies associated with the Promotion will not be responsible for any delay in delivery, loss or damage to, or caused by that prize.

19. The Promoter (including its officers, employees and agents) will not be liable for any loss (including without limitation, indirect or consequential loss), damage, personal injury, illness (including COVID-19) or death which is suffered (including but not limited to that arising from ant person’s negligence) in connection with the Promotion and/or any aspect of the prize or use of or taking the prize by the Winner. 

20. Nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth). 

21. The prize is not transferable, refundable, or exchangeable for cash or kind.

22. The Promoter may at its absolute discretion suspend, cancel, or recommence the Promotion if (a) for any reason the Promotion is not capable of proceeding as planned; (b) if the Promotion is corrupted or the administration, security, fairness, integrity or proper conduct of the Promotion is affected; or (e) if the determination of the Winner or delivery of prize is prevented or hindered by any event outside the Promoter’s control subject to regulatory authorities. 

23. The promoter’s decision is final and no correspondence will be entered into.

24. The Entrant agrees to the content of the Promoter’s Privacy Statement. The Promoter will collect personal information in order to conduct the Promotion, and for this purpose disclose such personal information to third parties, including but not limited to Retailers, agents, contractors, service providers, and prize suppliers. Entry in the Promotion is conditional on providing this personal information. The Promoter will also use and handle this personal information as described in its Privacy Statement. 25. The prize consists of 3 x $100.00 EFTPOS Gift Cards (individual gift card expiry terms and conditions apply) and 1 x large Teddy plush toy.

26.  While promoted on Facebook, this competition is in no way sponsored, endorsed or administered by, or associated with Facebook in any way.

27. The Competition or Promotion is open to anyone over the age of 14 years.
